Commercial handling (invoicing/settlement) may be carried out by ABC International Sp. z o.o., ul. Cyprysowa 8, 02-265 Warszawa, Poland, as a handling service provider acting in the name and for the account of Titan Cosmetics Sp. z o.o. The contracting party remains Titan Cosmetics Sp. z o.o. |
| 1. Scope of Application (B2C) |
These General Terms and Conditions (“Terms”) apply to all orders and purchase agreements for goods offered by Titan Cosmetics Sp. z o.o. (“Seller”) via the online shop or by telephone to consumers (“Customer”). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. |
| 2. Formation of Contract |
The presentation of goods in the online shop does not constitute a legally binding offer but an invitation to place an order. By clicking the button “order with obligation to pay” (or an equivalent wording), the Customer submits a binding offer to purchase the products in the shopping cart. Prior to submitting the order, the Customer may correct entries at any time (e.g., in the cart or via browser functions). The contract is concluded by: (a) order confirmation by e-mail or (b) shipping confirmation or (c) delivery of the goods. In case of obvious pricing errors or technical/system errors, the Seller reserves the right to cancel the order; payments already made will be refunded without undue delay. |
| 3. Prices, Shipping Costs, Taxes |
All prices are final prices (gross) in EUR and include the applicable VAT. Any shipping costs are shown during checkout before the order is placed. The final prices displayed in the shopping cart and checkout are binding. |
| 4. Payment Methods |
Payment methods (depending on availability in the shop): (a) bank transfer (prepayment) – shipment after payment is received; (b) PayPal; (c) card payment / online payment (if available). The Seller does not charge additional fees for the chosen payment method where such fees are prohibited by law or exceed actual costs. |
| 5. Delivery / Delivery Area |
We deliver to delivery addresses in Poland and to all Member States of the European Union. Deliveries to non-EU countries are not provided unless explicitly stated otherwise in the shop. |
| 6. Delivery Times (Indicative) |
Poland: 1–2 business days after receipt/payment authorization. EU (other Member States): 3–7 business days after receipt/payment authorization. Delivery times are non-binding estimates unless a binding delivery date has been expressly agreed. |
| 7. Transfer of Risk (B2C) |
For consumers, the risk of accidental loss or deterioration of the goods passes to the Customer only when the Customer receives the goods (or a third party designated by the Customer, who is not the carrier, receives them). If the Customer independently selects a carrier not offered by the Seller, the risk may pass to the Customer already upon handover of the goods to that carrier (statutory exception). |
| 8. Right of Withdrawal (14 Days) |
The Customer has the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which the Customer or a third party designated by the Customer (who is not the carrier) takes possession of the goods. To exercise the right of withdrawal, the Customer must inform the Seller (Titan Cosmetics Sp. z o.o., ul. Cyprysowa 8, 02-265 Warszawa, Poland, e-mail: info@titan-cosmetics.com) by an unequivocal statement (e.g., e-mail or letter). To meet the deadline, it is sufficient that the withdrawal notice is sent before the withdrawal period expires. |
| 9. Consequences of Withdrawal |
In the event of withdrawal, the Seller will refund all payments received from the Customer, including delivery costs (except for additional costs resulting from the Customer choosing a more expensive type of delivery than the cheapest standard delivery offered by the Seller), no later than 14 days from the day the Seller receives the notice of withdrawal. The Seller may withhold the refund until the goods have been received back or the Customer has provided evidence of having sent back the goods, whichever is earlier. Refunds will be made using the same payment method used by the Customer, unless expressly agreed otherwise. |
| 10. Return of Goods – Deadline and Costs |
The Customer must return the goods without undue delay and in any event no later than 14 days from the day the Customer informs the Seller of the withdrawal. The deadline is met if the goods are sent before the 14-day period expires. The Customer bears the direct costs of returning the goods unless the Seller has expressly agreed to cover such costs. |
| 11. Exceptions to the Right of Withdrawal (Hygiene / Seals) |
The right of withdrawal does not apply or expires—where provided by law—particularly in the case of sealed goods that are not suitable for return due to health protection or hygiene reasons if the seal was removed after delivery (e.g., certain cosmetic/hygiene products with tamper seals). |

| 13. Complaints and Legal Warranty (Defects Rights) |
The statutory consumer rights regarding lack of conformity and defects apply. The Customer’s rights in case of defective goods are governed by applicable law; the statutory minimum liability period for consumers in the EU is generally at least 2 years from delivery (details depend on national implementation). |
| 14. Liability |
The Seller is liable without limitation in cases of intent, gross negligence, injury to life, body or health, and under mandatory statutory provisions (e.g., product liability). In cases of slight negligence, the Seller shall only be liable for breach of essential contractual obligations; in such case, liability is limited to the foreseeable, typical damage. Mandatory consumer rights remain unaffected. |
| 15. Product Information / Images |
Product images are for illustrative purposes only; color deviations may occur. Lamps and visual variants may be delivered in different colors, provided the function remains identical and this is reasonable for the Customer. |
| 16. Promotions / Discounts |
Conditions of promotions, discounts and voucher codes result from the respective offer description and the terms displayed during checkout. |
| 17. Data Protection |
Information regarding the processing of personal data can be found in the Privacy Policy available in the online shop. |
| 18. Dispute Resolution |
To the extent permitted by law, the Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. |
| 19. Governing Law / Jurisdiction (B2C) |
Polish law applies. Mandatory consumer protection provisions of the country in which the Customer has their habitual residence remain unaffected. For consumers, the statutory rules on jurisdiction apply; no different place of jurisdiction is agreed. |
